User responsibility for uploaded content

By uploading, posting, submitting, sharing, or otherwise making available any image, photograph, video, audio recording, music, sound recording, artwork, document, or other content (“User Content”) through Th3 Platform LLC, you represent and warrant that:

You own all rights, title, and interest in the User Content; or
You have obtained all necessary licenses, permissions, authorizations, and legal rights from the copyright owner and any other applicable rights holders to upload, distribute, display, reproduce, or otherwise use the User Content.

You further represent that your User Content does not violate any copyright, trademark, publicity, privacy, or other intellectual property or proprietary rights of any third party.

Prohibited content

Users may not upload, publish, or distribute any content that:

Infringes another person’s copyright, trademark, or intellectual property rights.
Includes music, sound recordings, videos, images, or other media for which the user does not possess the necessary legal rights or authorization.
Violates applicable federal, New York State, or local laws.
Is fraudulent, deceptive, defamatory, or otherwise unlawful.

Copyright infringement

We respect the intellectual property rights of others. Any content reported or believed to infringe copyright or other intellectual property rights may be removed without prior notice and at our sole discretion.

We reserve the right to suspend or terminate the accounts of users who repeatedly violate intellectual property laws.

User indemnification

You agree to defend, indemnify, and hold harmless Th3 Platform LLC, its owners, officers, directors, employees, affiliates, contractors, licensors, and agents from and against any and all claims, lawsuits, damages, liabilities, judgments, settlements, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

Your uploaded content;
Your violation of these Terms;
Your infringement of any copyright, trademark, privacy, publicity, or other legal rights;
Any dispute between you and a third party concerning your User Content.

Limitation of responsibility

Th3 Platform acts solely as a platform that enables users to upload and share content.

We do not review, verify, or guarantee that User Content is owned by the individual uploading it, and we are not responsible for determining ownership or authenticity before content is submitted.

To the fullest extent permitted by applicable law, Th3 Platform disclaims liability for any unauthorized, infringing, or unlawful User Content uploaded by users. Nothing in these Terms shall be interpreted as limiting liability where such limitation is prohibited under applicable law.

Removal of content

We reserve the right, but have no obligation, to remove, restrict access to, or disable any User Content that we believe may violate these Terms, applicable law, or the rights of any third party.

Repeat infringer policy

Users who repeatedly upload infringing or unauthorized material may have their accounts suspended or permanently terminated without prior notice.

Compliance with applicable law

Users are solely responsible for ensuring that all uploaded content complies with applicable United States federal law, New York State law, copyright law, intellectual property laws, and all other applicable regulations.

By using Th3 Platform, you acknowledge that you are solely responsible for the content you upload and for any legal consequences arising from such content.

Reservation of rights

Th3 Platform reserves all rights and remedies available under applicable law to protect its business, users, and intellectual property. These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in the State of New York, unless otherwise required by applicable law.
