Employer job posting policy
This Employer Job Posting Policy (“Policy”) governs all employers, recruiters, staffing agencies, employment agencies, and businesses (“Employers”) that post employment opportunities on Th3 Platform. By posting a job listing, Employers agree to comply with this Policy, our Terms and Conditions, Privacy Policy, and all applicable federal, state, and local laws, including the laws of the State of New York.
Eligibility
Employers must:
- Be legally authorized to hire employees or independent contractors.
- Provide accurate business and contact information.
- Have the legal authority to advertise available positions.
- Comply with all applicable employment, labor, tax, and anti-discrimination laws.
We reserve the right to verify employer identities before or after a job posting is published.
Accurate job listings
Employers agree that all job postings must be truthful, current, and complete. Each listing must accurately describe:
- Job title
- Duties and responsibilities
- Employment type
- Work location
- Required qualifications
- Compensation, where required by applicable law
- Application instructions
- Employer identity
Employers may not publish misleading, deceptive, fraudulent, or inaccurate job advertisements.
Compliance with employment laws
Employers are solely responsible for ensuring that all job postings comply with applicable laws, including but not limited to:
- Equal employment opportunity laws
- Anti-discrimination laws
- Wage transparency requirements
- Labor laws
- Occupational safety laws
- Immigration and work authorization requirements
- New York State employment laws
- Applicable federal employment laws
Prohibited job listings
Employers may not post jobs that:
- Are fraudulent or deceptive.
- Misrepresent compensation or benefits.
- Require illegal activity.
- Promote discrimination or harassment.
- Require applicants to pay application fees or purchase products as a condition of employment.
- Collect unnecessary personal or financial information before a legitimate hiring process.
- Involve pyramid schemes, multi-level marketing programs requiring mandatory purchases, or other unlawful business opportunities.
- Violate any applicable law or regulation.
Employer responsibility
Employers are solely responsible for:
- The accuracy of job listings.
- Hiring decisions, employment offers, and employment contracts.
- Wage payments and employee classification.
- Compliance with employment laws.
- Communications with applicants.
Th3 Platform does not participate in hiring decisions and does not verify the accuracy of employer representations.
Applicant information
Employers agree to use applicant information only for legitimate recruitment and hiring purposes. Employers may not:
- Sell applicant information.
- Share applicant information without authorization.
- Use applicant information for marketing without consent.
- Retain applicant information longer than permitted by applicable law.
Fees
If Th3 Platform charges fees for job postings or related services, all fees are non-refundable unless otherwise stated in writing or required by law.
Monitoring and removal
We reserve the right, but are not obligated, to:
- Review job postings.
- Remove listings that violate this Policy.
- Request additional documentation from Employers.
- Suspend or terminate Employer accounts.
- Refuse publication of any job listing at our sole discretion.
No guarantee of applicants
Th3 Platform does not guarantee the number of applicants, applicant qualifications, successful hiring, employment outcomes, or candidate availability.
No employment relationship
Th3 Platform is solely an online marketplace connecting Employers and job seekers. Nothing in this Policy creates an employment relationship, agency, partnership, joint venture, or contractor relationship between Th3 Platform and any Employer or applicant.
Employer indemnification
Employers agree to defend, indemnify, and hold harmless the Company, its owners, officers, directors, employees, affiliates, contractors, licensors, and agents from and against any claims, damages, liabilities, losses, judgments, settlements, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to employer job postings, hiring practices, employment decisions, violations of employment laws, wage disputes, discrimination claims, applicant complaints, or breach of this Policy.
Limitation of liability
To the fullest extent permitted by law, Th3 Platform is not responsible for the accuracy of job postings, employer hiring decisions, employment offers or rejections, salary negotiations, employment disputes, workplace conduct, payroll or benefits, employment termination, or any damages arising from interactions between Employers and applicants.
Reservation of rights
We reserve the right to modify, suspend, or discontinue Employer accounts or job listings at any time where necessary to protect Th3 Platform, users, or comply with applicable law.
Governing law
This Policy shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of New York, except where otherwise required by applicable law.
